Șeful interimar al Inspecției Muncii, Mihai Nicolae Ucă, a declanșat o campanie națională de control pentru verificarea respectării prevederilor legislației muncii în centrele de asistență socială

Inspecția Muncii, instituția în fruntea căruia Ucă a fost numit interimar în luna iulie, a derulat în perioada 1-18.08.2023 o campanie națională ce a vizat acțiuni de control pentru pentru verificarea modului de respectare a prevederilor legale privind încheierea și executarea contractelor individuale de muncă și pentru verificarea modului în care sunt respectate cerințele minime pentru îmbunătățirea securității și protecția sănătății lucrătorilor, de către angajatorii care desfăşoară activități în următoarele domenii: asistență socială, cu cazare; asistență socială, fără cazare; activități ale centrelor de îngrijire medicală și activități ale centrelor de recuperare psihică și de dezintoxicare, exclusiv spitale.

Au fost făcute 1951 de controale. Câte amenzi s-au dat

„Am dispus această campanie pentru a ne asigura că drepturile salariaților entităților vizate de campanie sunt respectate și că angajatorii se conformează reglementărilor legale în vigoare în ceea ce privește relațiile de muncă și securitatea și sănătatea în muncă”, a declarat Mihai Nicolae Ucă, inspector general de stat adjunct la Inspecția Muncii.

Din câte a precizat Ucă, citat într-un comunicat transmis miercuri de Inspecția Muncii, la nivel național au fost făcute 1951 de controale, din care 988 în domeniul relațiilor de muncă și 963 în domeniul SSM, „în urma cărora au fost aplicate 1147 de sancțiuni, din care 100 de amenzi, în valoare totală de 647.000 de lei și 1047 de avertismente”.

„11 amenzi au fost aplicate angajatorilor pentru muncă nedeclarată, 27 de amenzi pentru nerespectarea prevederilor privind timpul de muncă și 15 amenzi în baza altor prevederi legale. Au fost depistate 22 de persoane prestând muncă nedeclarată, aflate în următoarele situații: 9 nu au avut încheiat contract individual de muncă cel târziu în ziua anterioară începerii activităţii, 4 nu au avut transmise elementele contractului individual de muncă în registrul general de evidenţă a salariaţilor cel târziu în ziua anterioară începerii activităţii și 9 au depăşit durata timpului de muncă stabilită în cadrul contractelor individuale de muncă cu timp parțial. Ca urmare a tuturor neconformitățile despistate, inspectorii de muncă au dispus 1861 de măsuri obligatorii de intrare în legalitate, cu termene precise de îndeplinire”, a mai anunțat Mihai Nicolae Ucă.

Conform comunicatului, cele mai frecvente deficienţe constatate în domeniul relațiilor de muncă au fost:

  • nerespectarea obligației legale de a ține evidența timpului de muncă la locul de muncă, prin evidențierea numărului de ore efectiv lucrate de către salariați;
  • utilizarea muncii nedeclarate, în principal prin neîncheierea în formă scrisă a contractului individual de muncă, anterior începerii activității;
  • nerespectarea dispoziţiilor legale privind durata maximă a timpului de muncă, necompensarea orelor suplimentare cu timp liber corespunzător sau neacordarea sporului corespunzător la salariu, în cazul în care compensarea prin ore libere plătite nu este posibilă;
  • nerespectarea dispoziţiilor legale privind munca de noapte;
  • neacordarea repausului săptămânal.

Totodată, s-a anunțat și cele mai frecvente deficienţe constatate în domeniul securităţii şi sănătăţii în muncă:

  • lipsa verificărilor periodice, conform prescriptiilor tehnice ISCIR, pentru centrale termice, lifturi, elevatoare cu șenile pentru scări şi alte echipamente similare;
  • lipsa lucrătorilor desemnaţi/instruiți care aplică măsurile de prim ajutor, stingerea incendiilor şi evacuarea lucratorilor;
  • nu s-au asigurat stingătoare de incendiu, trusele de prim ajutor sunt expirate şi incomplete;
  • ușile de ieșire în caz de urgență nu se deschid spre exterior;
  • lipsa verificării periodice a centurii de împământare efectuată de persoane autorizate și instalaţii electrice degradate;
  • piese de mobilier nefixate corespunzător împotriva riscului de cădere;
  • neefectuarea controlului medical si psihologic pentru lucrători, inclusiv pentru cei care desfăşoară muncă de noapte;
  • lipsa autorizației de funcţionare din punct de vedere al securității și sănătății în muncă;
  • neasigurarea semnalizării de securitate şi/sau sănătate în muncă la toate locurile de muncă;
  • neacordarea de echipamente individuale de protecţie pentru lucrători, conform riscurilor evaluate sau nepurtarea echipamentelor individuale de protecţie din dotare de către lucrători și instruire necorespunzătoare în domeniul securităţii şi sănătăţii în muncă;
  • neetichetarea recipientelor cu substanţe chimice;
  • planul de prevenire şi protecţie incomplet, în sensul că nu au fost stabilite măsurile de prevenire şi protecţie corespunzătoarere si persoanele responsabile;
  • neautorizarea lucrătorilor care desfăşoară activităţi prevăzute de legislaţia specifică (fochist, electrician etc.).
